Terms of Service

1. Service Description

Ficanaz is a tool for people who sell on MercadoLibre and similar marketplaces. The Service lets you:

• Research products with artificial intelligence, combining what the AI proposes with figures measured on MercadoLibre.
• Connect your MercadoLibre account to review your own listings, sales, questions, claims and promotional campaigns (see Section 4).
• Use an AI assistant that reads data from your connected account and, only where you have explicitly enabled it, proposes changes to that account which are applied after you review and confirm each one.
• Use Ficanaz Link, an optional connector that exposes the same assistant to an AI client of your choice, such as Claude or ChatGPT (see Section 5).

The Service may show links to third-party platforms such as MercadoLibre or supplier websites. Those platforms are not part of the Service.

2. Account Registration

To use the Service, you must create an account by providing accurate and complete information, including a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years of age to use the Service. One account is for one person; see Section 6. You agree to notify us immediately of any unauthorized access to your account.

3. Plans, Credits and Payments

3.1 Free Account

Creating an account is free and requires no payment method. Features that do not use artificial intelligence — such as browsing your own listings, managing promotions and reviewing your history and saved results — are available at no cost. The free account has no monthly fee, no contract and no automatic charge of any kind.

3.2 Credits

Actions that use artificial intelligence are paid with prepaid credits. Each action debits credits according to the computing resources it actually consumes, so the cost of a given action varies with its size and complexity; the Service shows the cost of each action. New accounts receive a one-time allotment of welcome credits at no charge; an email that has already deleted an account does not receive welcome credits again. Credits are a prepaid balance usable only within the Service: they are not money, they are not transferable between accounts and they cannot be exchanged for cash except as expressly provided in our Refund Policy.

3.3 Credit Packs

Additional credits are bought in packs as one-time payments. Buying a pack does not create a subscription and does not renew automatically; you are charged only when you choose to buy a pack. Pack sizes and prices are listed on the credits page within the Service and are stated in US dollars (USD).

3.4 Credits Do Not Expire

Purchased credits do not expire and are not reset on any monthly or annual cycle. They remain in your account until you consume them or your account is closed (see Section 12). Welcome credits, referral credits, the monthly credits included in the Pro plan and any other credits granted at no charge have no cash value and are not refundable.

3.5 Pro Plan

The Pro plan is an optional monthly subscription priced at USD 9.99 per month. It includes everything in the free account plus Ficanaz Link (Section 5) and 300 credits added to your balance each time a monthly invoice for the plan is paid with a charge greater than zero, at most once per billing period. The trial includes Ficanaz Link but no credits: the monthly credits start with the first paid invoice.

• Trial. New accounts get a 14-day Pro plan trial that starts automatically when the account's email address is confirmed; an existing account that has not used it yet can start it once from its account. The trial requires no payment method. If you have not added a payment method by the end of the trial, the subscription ends by itself, nothing is charged and the account stays on the free plan with its credit balance. The trial is offered once per person: an email address that already used it (including variations of the same mailbox, or a deleted and re-created account) does not get a new one.
• Renewal. After the trial, and if you have added a payment method, the plan renews automatically every month and the monthly fee is charged at the start of each billing period until you cancel.
• Cancellation. You can cancel at any time from your account (Credits → Pro plan → Manage subscription), which opens the Stripe customer portal. After cancelling you keep Pro access until the end of the period you already paid for, and you are not charged again. Refunds for the Pro plan are governed by our Refund Policy.
• Monthly credits. The credits included in the plan are granted at no charge and are governed by Section 3.4. If a Pro invoice is refunded or disputed, we may remove the credits that invoice granted, which can leave your balance negative until it is settled.
• Unpaid invoices. If a renewal payment fails, Stripe retries it; while the invoice is unpaid your Pro features may be limited and the subscription may be cancelled.

3.6 Payment Processing and Taxes

All payments are processed by Stripe, a third-party payment processor, in US dollars. By making a purchase you agree to Stripe's terms of service. We do not store your payment card details on our servers. Prices do not include any taxes, duties or bank or currency-conversion fees that may apply to you under the laws of your country; you are responsible for those.

3.7 Changes to Prices and Rates

We may change the price of credit packs, the price of the Pro plan and the rate at which actions consume credits. Pack prices apply as published at the time of purchase; a change never alters the price of a purchase already made. A change to the Pro plan price applies from your next renewal after we have given you at least 30 days' notice by email, so you can cancel before it takes effect. Changes to how many credits an action consumes apply only to actions performed after the change takes effect, and we will give at least 30 days' notice before any change that materially increases the number of credits a comparable action consumes.

3.8 Refunds

Refunds of purchased credits and of Pro plan payments are governed by our Refund Policy, which forms part of these Terms.

4. Your Connected MercadoLibre Account

You may connect your MercadoLibre seller account to the Service through MercadoLibre's own authorization flow (OAuth). When you do, MercadoLibre issues the Service an access token that we store encrypted and use only to act on your behalf within the Service. You can disconnect at any time from Integrations; when you do, we revoke the authorization with MercadoLibre and delete the token.

• What we read. With your authorization the Service reads your listings, prices, stock, sales, visits, questions, post-sale messages, claims, shipments, promotions and advertising data, as made available by MercadoLibre's API. Payment and billing data from Mercado Pago is never requested.
• What we write. The Service only changes your account when you ask it to. Every change is shown to you first as a proposal — the item, the current value and the new value — and is applied only after you confirm it. Higher-impact changes require an additional explicit confirmation. The Service never deletes a listing: that action is blocked by design and you must perform it on MercadoLibre yourself.
• Permissions. Each type of change (prices, stock, listings, promotions, questions, messages, claims, shipping, advertising) is off by default and must be enabled by you in the assistant's permissions. You can turn any of them off at any time.
• MercadoLibre's rules apply. MercadoLibre applies its own rules to every change (for example, increasing the stock of a paused listing may reactivate it). We cannot promise what a change will or will not trigger on MercadoLibre. You remain responsible for complying with MercadoLibre's terms, policies and local law in everything you do with your account, including changes you confirm through the Service.
• Your buyers' data. Some of the data MercadoLibre provides concerns your buyers. You are the party responsible for that data under MercadoLibre's terms and applicable privacy law; we process it only to provide the Service to you, as described in our Privacy Policy, and we remove buyers' names, contact details, documents and addresses before any of it reaches an AI model.
• Availability. MercadoLibre may change, restrict or withdraw API access without notice. When a piece of data is not available, the Service says so instead of showing an estimate.

5. Ficanaz Link

Ficanaz Link lets you use the assistant from an AI client you already use — such as Claude, ChatGPT or another client compatible with the Model Context Protocol (MCP) — instead of from the Ficanaz website. It is included in the Pro plan.

• Your AI client, your agreement. When you connect Link, the results of the tools you call — which include data from your connected MercadoLibre account — are delivered to your AI client and processed by its provider (for example Anthropic for Claude or OpenAI for ChatGPT) under your own agreement with that provider. We do not control, and are not responsible for, how that provider stores or uses what you send it. The AI usage itself is billed by that provider, not in Ficanaz credits.
• Authorization. You authorize a client by signing in to Ficanaz and granting access on the consent screen. You can see every authorized client and revoke any of them at any time from the Link panel in your account. Once revoked, that client's token stops working; MercadoLibre tokens are never shared with the client.
• Changes through Link. The same rules as Section 4 apply: each change is first created as a proposal, must be confirmed, and respects the permissions you enabled. Your AI client is expected to show you the proposal and ask you before confirming, but the client is operated by its provider and we cannot guarantee how it behaves. You are responsible for every change confirmed from a client you authorized. If you do not want a client to be able to change anything, keep the write permissions off.
• Activity log. Every call made through Link is recorded (client, tool, a truncated copy of the input, result and duration) and shown to you in the Link panel, so you can audit what your clients did.
• Limits. We apply per-account limits on the number of calls per minute to protect the Service and MercadoLibre's API quota, which is shared across our users. A client that exceeds them receives an error and can retry later.

6. Acceptable Use

You agree not to:

• Share your account credentials with third parties or allow multiple users to access a single account
• Create multiple accounts, delete and re-create accounts, or use the referral program in order to obtain credits you would not otherwise receive
• Connect a MercadoLibre account you are not authorized to operate
• Use the Service, including Ficanaz Link, to violate MercadoLibre's terms or policies or any applicable law
• Attempt to circumvent credit charges, usage limits, permissions, confirmation steps or other technical controls of the Service
• Attempt to reverse-engineer, decompile or disassemble any part of the Service
• Use automated systems (bots, scrapers) to access the Service beyond the intended interface or the Ficanaz Link connector
• Resell, redistribute or sublicense access to the Service or its data without written consent
• Interfere with the proper functioning of the Service or its infrastructure
• Use the Service to harass, defame or harm any person or entity

7. Referral Program

Each account has a referral code. When a new user registers with your code and confirms their email, they receive referral credits; you receive yours when that user makes their first purchase (a credit pack or the first paid Pro invoice). The amounts are those shown in the Service at that time. Referral credits are granted at no charge and are governed by Section 3.4. There is a cap on the number of referrals for which the referrer is paid; the Service shows it. We may withhold or remove referral credits obtained through fake accounts or other abuse, and we may change or end the program at any time without affecting credits already granted.

8. Intellectual Property

8.1 Our Property

The Service, including its design, features, code, content, trademarks and logos, is owned by Ficanaz LLC and is protected by intellectual property laws. Nothing in these Terms grants you any right to use our trademarks or branding without prior written consent.

8.2 Your Data

You retain ownership of any data you input into the Service and of the data of your MercadoLibre account. By using the Service, you grant us a limited license to process that data solely for the purpose of providing the Service to you.

8.3 AI-Generated Content

Research results, analyses, proposals and other outputs generated by the Service for you are yours to use for your business decisions. We do not claim ownership over AI-generated results delivered to you.

9. Use of Artificial Intelligence

The Service uses artificial intelligence, including large language models provided by our sub-processor Anthropic, to generate product research, analyses of marketplace data, answers from the assistant and proposals of changes. You should know the following:

• The AI proposes; MercadoLibre measures. The Service does not invent scores, demand levels, profit margins or sales estimates. Figures shown as measured come from MercadoLibre's API using your authorization, and the Service tells you where each figure came from and when it was read. Where something cannot be measured, the Service says so rather than estimating.
• Outputs are probabilistic. AI-generated text may contain inaccuracies, omissions or outdated information and must be independently verified before you act on it.
• No automated decisions about you. The Service does not make automated decisions that produce legal or similarly significant effects concerning you. Every change to your MercadoLibre account requires your confirmation.
• Data sent to AI providers. What is sent to Anthropic, and what reaches your own AI client through Ficanaz Link, is described in our Privacy Policy.
• Rating the assistant. Rating an answer is optional. Conversations you rate are used to improve the Service; those in which you rate an answer negatively are kept for up to 12 months instead of the usual 90 days, and personal data of third parties is anonymized before they are used in any evaluation. Details are in our Privacy Policy.

10. Disclaimers

10.1 No Guarantee of Results

We do not guarantee the accuracy, completeness or timeliness of any information provided, nor any commercial result from using the Service. Product trends, prices, supplier availability and the rules of MercadoLibre may change at any time.

10.2 Third-Party Platforms

The Service may contain links to third-party websites, including MercadoLibre and supplier platforms. We are not responsible for the content, products, services or practices of any third party. Your relationship with MercadoLibre, with suppliers and with the provider of any AI client you connect through Ficanaz Link is solely between you and them.

10.3 No Financial or Business Advice

The Service does not constitute financial, investment, legal, tax or business advice. You are solely responsible for your business decisions, including purchasing inventory, setting prices and discounts, selecting suppliers and every change you confirm on your MercadoLibre account.

10.4 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FICANAZ LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, SALES, REPUTATION ON ANY MARKETPLACE, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING CHANGES TO YOUR MARKETPLACE ACCOUNT THAT YOU CONFIRMED. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the law that applies to you, or any mandatory consumer rights you have in your country of residence.

12. Account Suspension and Termination

12.1 By You

You may stop using the Service at any time. If you are on the Pro plan, cancel it first (Section 3.5) so that no further charges occur. You may also permanently delete your account from your account settings; the Service will not let you delete an account with an active Pro subscription until it is cancelled. Deleting your account disconnects your MercadoLibre account, revokes every Ficanaz Link client and erases your data and your credit balance: any remaining credits, whether purchased or granted, are forfeited and cannot be restored afterwards. If you have purchased credits that you have not consumed, request a refund under our Refund Policy before deleting your account.

12.2 By Us

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity or abuse of credits, initiate a payment dispute without contacting us first, or if MercadoLibre requires us to stop acting on your account. We will provide reasonable notice before termination, except in cases of severe violations.

13. Usage Limits

Actions that use artificial intelligence require a sufficient credit balance. When your balance is not enough to cover an action, that action is blocked until you add credits; the rest of the Service remains available. We also apply reasonable technical limits — such as a cap on requests per minute, a maximum number of steps or credits within a single assistant conversation, and the Ficanaz Link limits in Section 5 — to protect the Service, to respect MercadoLibre's API quota and to prevent runaway costs. Where such a limit applies, the Service tells you.

14. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use and protect your personal information and the data of your MercadoLibre account.

15. Modifications to the Service and Terms

We may modify these Terms or any aspect of the Service at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance of the modified Terms. If you do not agree with a change, cancel any subscription and stop using the Service before it takes effect.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Wyoming. If you are a consumer, this Section does not deprive you of the protection of mandatory consumer-protection rules of your country of residence or of the right to bring a claim before the courts or consumer authorities of that country where such rules so provide.

17. Indemnification

You agree to indemnify and hold harmless Ficanaz LLC, its officers, directors, employees and agents from any claims, damages, losses or expenses arising from your use of the Service, from changes to your MercadoLibre account that you confirmed, from your breach of MercadoLibre's terms, or from your violation of these Terms.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
