1. Service Description

Ficanaz is an AI-powered product research platform that helps ecommerce entrepreneurs discover trending products, analyze market data, and access supplier information. The Service provides product recommendations, technical specifications, market analysis, and links to third-party supplier platforms such as Alibaba.

2. Account Registration

To use the Service, you must create an account by providing accurate and complete information, including a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years of age to use the Service. You agree to notify us immediately of any unauthorized access to your account.

3. Subscription Plans and Billing

3.1 Plans

The Service is offered through paid subscription plans (Starter, Pro, and Empire), each with different features and usage limits as described on our pricing page.

3.2 Free Trial

New accounts may receive a 7-day free trial with full access to the selected plan's features. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial period ends.

3.3 Billing

Subscriptions are billed monthly or annually, depending on the billing cycle you select. All fees are charged in advance and are non-refundable except as described in our Refund Policy. Prices are listed in US dollars (USD).

3.4 Payment Processing

All payments are processed by Stripe, a third-party payment processor. By subscribing, you agree to Stripe's terms of service. We do not store your credit card information on our servers.

3.5 Price Changes

We may change subscription fees at any time. Any price changes will take effect at the start of your next billing cycle. We will provide at least 30 days' notice before any price increase.

4. Acceptable Use

You agree not to:

• Share your account credentials with third parties or allow multiple users to access a single account
• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Use automated systems (bots, scrapers) to access the Service beyond the intended interface
• Resell, redistribute, or sublicense access to the Service or its data without written consent
• Interfere with the proper functioning of the Service or its infrastructure
• Use the Service to harass, defame, or harm any person or entity

5. Intellectual Property

5.3 AI-Generated Content

Product research results, recommendations, and analyses generated by the Service are provided for informational purposes only. You are free to use this information for your business decisions, but we do not claim ownership over AI-generated results delivered to you.

6. Disclaimers

6.1 No Guarantee of Results

The Service provides AI-generated product recommendations and market analysis based on publicly available data. We do not guarantee the accuracy, completeness, or timeliness of any information provided. Product trends, prices, margins, and supplier availability may change at any time.

6.2 Third-Party Links

The Service may contain links to third-party websites, including Alibaba and other supplier platforms. We are not responsible for the content, products, services, or practices of any third-party websites. Your interactions with third-party suppliers are solely between you and the supplier.

6.3 No Financial or Business Advice

The Service does not constitute financial, investment, or business advice. Product recommendations and market data are provided for informational purposes only. You are solely responsible for your business decisions, including purchasing inventory, setting prices, and selecting suppliers.

6.4 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FICANAZ LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Account Suspension and Termination

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period.

8.2 By Us

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or fail to pay applicable fees. We will provide reasonable notice before termination, except in cases of severe violations.

9. Usage Limits

Each subscription plan includes a specified number of product research queries per month. If you exceed your plan's limit, additional searches will be blocked until the next billing cycle or until you upgrade your plan. Unused searches do not roll over to the next month.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Modifications to the Service and Terms

We may modify these Terms or any aspect of the Service at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Wyoming.

13. Indemnification

You agree to indemnify and hold harmless Ficanaz LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or your violation of these Terms.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
